TERMS AND CONDITIONS
This contract applies solely to sales between the customer and the Imagerie d’Epinal.

ARTICLE 1 : Area of relevance
These terms and conditions concern the sale of products on the site www.imagerie-epinal.com, meaning terms and conditions for ordering, payment, delivery and management of any ordered products returned by customers. When a customer ticks the box "I accept the terms and conditions of sale" on submitting their order on www.imagerie-epinal.com this indicates their automatic and irrevocable agreement to these terms and conditions of sale and there are no exceptions to this. In general, these conditions apply no matter the means used by the customer to place their order and supersede all other conditions, except where a written agreement has been signed by both parties.

ARTICLE 2 : General description of the products
In order to inform the customer, the Imagerie d'Epinal presents a description of the products for sale on its website. In the same way, the photographs and graphics of products for sale are only indicative and do not constitute any commitment on the part of the seller. Nevertheless, the Imagerie d'Epinal is careful to make sure that the products are sent as ordered. If a customer wishes to obtain further information on products, they can contact the Imagerie d'Epinal on +33 (0)3 29 31 28 88 from 9am to 6.30pm from Monday to Saturday or by email at contact@imagerie-epinal.com. The Imagerie d'Epinal reserves the right to modify or change the products in its catalogue without warning. All products for sale on www.imagerie-epinal.com are new and conform to legislation and to current European standards.

ARTICLE 3: Price
The sale prices of the products on the website are in Euros and include all taxes but not delivery costs. All prices could possibly be subject to typing errors. Due to the constant evolution of supplier prices, we reserve the right to change prices on the website at any time. When a customer orders a product, he agrees to buy that product at the price indicated on the website at the time he made the order. Where an order is made from a country other than France, the buyer is the importer of the product/s concerned. For products sent outside the European Union or French overseas departments and territories the delivery cost before tax is added automatically to the bill. Customs charges, other local taxes, import taxes or other state taxes are liable to be added. These charges are in no way the responsibility of the Imagerie d’Epinal. They are the responsibility of the buyer and any customs declarations or payments to the authorities and relevant organisations in the customer’s home country must be paid for by them. We would recommend the customer to find out about these aspects with their local authority before placing their order.

ARTICLE 4 : Delivery costs
Delivery costs are the responsibility of the customer and are billed in addition to the sale price of products. Delivery costs are variable according to the weight of the package to be delivered. The customer will always be informed of the delivery costs of their order before the definitive submission of their order and payment will be demanded from the customer for the total purchase amount.

ARTICLE 5 : Placing an order
The customer can place their order on Imagerie d'Epinal’s website at www.imagerie-epinal.com following the order procedure (payment by bank card). Any order made on the website www.imagerie-epinal.com is confirmed by the sending of a confirmation email to the customer. This is only possible if the customer has correctly submitted their email address. It is strongly recommended to customers who order on the website to save or print a copy of the order and keep it until they receive their order. To modify their order customers must call the Imagerie d’Epinal on +33 (0) 3 29 31 28 88 from Monday to Friday from 9am to 6.30pm. Please note that it is not possible to modify an order that has already been dispatched.

ARTICLE 6 : Product availability
Products are offered according to stocks available. Information given on the site www.imagerie-epinal.com is given as a guide. Products are dispatched within 24 hours of receipt of the order; however the Imagerie d’Epinal reserves the right to modify this time frame depending on the product/s ordered.

ARTICLE 7 : Means of payment and safety
The total amount corresponding to the product ordered, delivery costs included, is due in full from the moment the order is placed, that is to say from the moment the confirmed order is received. Payment can be made by bank card – all payments by bank card are subject to validation checks which can entail a delay of 24 hours. The Imagerie d’Epinal reserves the right to cancel an order. To avoid any delay in processing your order please give a telephone number that we can contact you on at any time of the day to resolve any problems, as well as an email address.

ARTICLE 8 : Defaulting on payment
In case of a customer defaulting on a payment, in particular where the bank refuses to honour a payment, the Imagerie d’Epinal has the right within the law to cancel the sale without warning or delay. The Imagerie d’Epinal in particular reserves the right to refuse to make a delivery or to honour an order from a customer who has failed, wholly or partly, to pay for a previous order or with whom there is currently a dispute.

ARTICLE 9 : Means of delivery
Delivery means delivering the product to the customer at the location indicated when the order was placed. Products are sent by post. The customer must check the state of the merchandise packaging when the delivery is made and they must indicate any problems to the Imagerie d’Epinal that same day by telephone on +33 (0) 29 31 28 88 (from Monday to Friday from 9am to 6.30pm) or by email (contact@imagerie-epinal.com).

ARTICLE 10 : Delivery time frames
Delivery time frames are dependent on the availability of products ordered and the payment method chosen by the customer. Payment by bank card means that the order will be processed more quickly than if other payment methods had been used. Orders placed by internet are processed twice a day, at the start of the morning and the start of the afternoon. The customer must in principal allow for a day of preparation (processing the order, billing, preparing the product/s, packing them up) before they are able to be sent – this is for merchandise paid for with a credit card and that the company has in stock. Where several products are ordered the delivery time frames will be longer. The Imagerie d’Epinal hereby informs the customer that our delivery time frames (between 24 and 72 hours) are those which have been quoted to us by the postal services and are only given as indications. The non-respect of these time frames by the postal services is not under any circumstances the responsibility of the Imagerie d’Epinal. Only working days are counted when calculating these time frames.

ARTICLE 11 : Delays, errors or anomalies in delivery
The delivery time mentioned in the product descriptions is only indicative. Exceeding these time limits in no case constitutes grounds for legal proceedings. The customer must indicate in writing (email or letter) any delay in delivery from the confirmation that it has been sent in order to allow the Imagerie d'Epinal to carry out an investigation with the carrier. An investigation can last up to 21 working days. If during this time the product turns up, it will immediately be sent to the home of the person who ordered it as detailed on the order slip. However if the product ordered does not turn up within 21 days of the investigation being opened, the Imagerie d'Epinal will undertake, at their own cost, to send a new version of the product ordered by the customer. In case of product exchange, all delivery costs must be paid by the customer. In cases of error or anomaly such as damaged goods, damaged packaging and/or goods not matching what was ordered (according to the order slip), the customer must firstly refuse to accept delivery of the package, indicating the nature of the problem on the delivery slip and secondly they must inform the Imagerie d'Epinal the same day by email at the following address: contact@imagerie-epinal.com, or by telephone. Any claim made where the guidelines and timelines above were not followed will not be taken into account and this non-respect of the above guidelines and timelines releases the Imagerie d'Epinal from any responsibility vis-à-vis the customer.

ARTICLE 12 : Change or cancellation of order
To cancel or modify an order, please call the Imagerie d'Epinal on +33 (0)3 29 31 28 88 (Monday to Friday, 9am to 6.30pm). We will then be able to let you know whether it is possible for us to cancel the order. You will be informed by email that your order has been despatched and once this message has been sent it is no longer possible to cancel the order.

ARTICLE 13 : "Cooling off period"
According to article L.121-20 of the Consumer’s Charter, the customer has 7 days from the day of delivery of a product bought on www.imagerie-epinal.com to return the product (complete and in its original packaging) to the Imagerie d'Epinal for an exchange or refund, without having to give a reason or pay any penalties except for the cost of sending the product back to us. The timescale mentioned above runs from the time the package is received, the delivery slip being the proof of this. When the 7 days runs out on a Saturday, Sunday or public holiday, it is postponed until the next working day. The Imagerie d'Epinal will not however accept exchanges or refunds of products if all the above conditions are not fulfilled – the customer must let us know that they intend to return the package to the Imagerie d'Epinal by telephoning (+33 (0)3 29 31 28 88) or by email (contact@imagerie-epinal.com). The return of the products must be done in the timescales as set out; the date on the delivery slip will be proof of this. The product must be returned in its original and intact packaging, accompanied by the bill – any damaged product or whose original packaging has been altered will not be exchanged or reimbursed. Any return by post must be Recorded Delivery, signed for (if not, there will be no record of any products lost in the post) to the following address: IMAGERIE D'EPINAL – 42 bis Quai de Dogneville- 88000 EPINAL, France. The Imagerie d'Epinal reserves the right to determine in good faith if all these conditions have been met. On receiving the product sent by the customer, the Imagerie d'Epinal will send an email to confirm receipt of the product. According to article L121-20-3 of the Consumer’s Charter, once the right to benefit from the “Cooling off period” has been exercised, the seller is bound to reimburse the buyer without delay and at the latest within 30 days. The reimbursement can be made in the form of a voucher. The costs and risks relative to the return of the product are exclusively the responsibility of the customer.

ARTICLE 14 : Limits of responsibility
The Imagerie d'Epinal will not be held responsible for breaches of contract due to force majeure; disturbances; full or partial strikes (notably of the postal services, means of transport or communications); flood, fire or war. The Imagerie d'Epinal can never be liable for more than the price of the product sold.

ARTICLE 15 : Personal data
Data requested from the customer is necessary to process their order. Where there is no express opposition on their part, the buyer gives their consent for the use of their personal data inputted during their order as part of the seller’s customer files, as well as their consent to receive the newsletter from www.imagerie-epinal.com. According to the Freedom of Information Act the customer has the right to access and modify the information held on the database of www.imagerie-epinal.com at any time. To exercise this right they should address their request to IMAGERIE D'EPINAL, 42 bis Quai de Dogneville, 88000 EPINAL, France. The Imagerie d'Epinal will not resell or give out any personal information concerning their customers to other companies.

ARTICLE 16 : Disputes
In the case of a dispute with industry professionals : these terms and conditions are regulated in their interpretation and their execution by French law. In case of a dispute, the client should in the first instance address the Imagerie d'Epinal to try to find an amicable solution. Any disagreement relating to the formation, execution or the cessation of contractual obligations between the parties where an amicable solution cannot be found will be subject to the jurisdiction of the Bankruptcy Court of Epinal (where the Headquarters of the seller is) and whatever the terms and conditions and accepted mode of payment, the seller reserves the right to refer the matter to the court in the area where the buyer’s Headquarters are. In case of a dispute with individuals : these terms and conditions are subject to (in their interpretation and for their execution) by French law. In case of a dispute, the client must in the first instance contact the Imagerie to try to find an amicable solution. Any disagreement relating to the formation, execution and cessation of contractual obligations between the parties where an amicable solution cannot be found will be subject to the relevant jurisdiction according to French law.

All images and objects on this website are brands or trademarks of the Imagerie d’Epinal. Their presence on this website does not in any way constitute a license or give the right to use any of the aforementioned images, which cannot therefore be used without prior written consent from the Imagerie d’Epinal or this will be considered a breach of copyright.
